Types of Personal Injury Claims Our Firm Handles

Lead attorney Richard D. Saul has extensive experience negotiating and litigating all types of injury claims, including:

Car Accidents

Under New York’s No-Fault Insurance Law, you must seek damages from your own insurance company for medical bills and lost wages if you have been injured in a car accident, regardless of which driver was at fault. Furthermore, you can bring a personal injury lawsuit against the other driver and vehicle owner if you suffer a “serious injury” under state law. You can trust Richard to protect you from liability, put forth your “serious injury” claim, and get you the maximum compensation you deserve. We have recovered millions of dollars for car accident victims just like you!

Bicycle Accidents

Bicycle riders must take precautions for their safety to some degree; however, all car drivers must be aware of their surroundings and be on the lookout for bicyclists. Bicycle victims have a right to recovery for both, No-Fault benefits covering medical bills and lost wages and injuries including pain and suffering against the responsible car driver and owner. We assist in filing your No-Fault Benefits application which must be done within 30 days of the accident. We will then attempt to negotiate a reasonable settlement for your injuries. If a reasonable settlement cannot be reached, we will file a full in-court lawsuit and fight to get you every dollar you deserve. We have recovered millions of dollars for clients just like you! If you or a family member have suffered an injury in a bicycle accident, our firm will fight to protect your rights.

Construction Accidents

Residential and commercial property development is lucrative for developers and investors. However, construction workers often pay the price: construction accidents can result in catastrophic and fatal accidents. Although injured construction workers are eligible for workers’ compensation benefits, they can pursue a separate personal injury claim when the construction site is deemed to be in an unsafe condition for the workers and/or work being performed at the site under New York Labor Laws 200, 240, and 241. Although these claims can be complicated, we have extensive experience in processing and winning substantial recoveries for workers just like you. Call us today to protect your rights!

Dog Bites

Most dogs are friendly pets and faithful companions, but each year, thousands of individuals are injured in dog bite incidents – nearly half involve children. New York has a “strict liability” dog bite rule. This means you can recover damages if you show the dog had a prior propensity to be dangerous or aggressive and the owner knew or should have known of the danger. Also, the owner of a “dangerous dog” may be strictly liable for a dog bite victim’s medical costs. Dog bite cases involve a substantial amount of investigation in order to successfully prove the case. This may include visiting the dog owner’s property, talking with the neighbors, or checking for prior incident records with the local town. If you or a loved one has been injured due to a dog bite, don’t go at it alone. We have extensive experience with dog bite claims and have recovered substantial compensation for clients just like you!

Medical Malpractice

We place our trust and often our well-being in the hands of doctors and expect to receive quality care. When a healthcare provider’s negligence causes harm by deviating from the normal and accepted treatment standards and practices within your area, victims can file a medical malpractice lawsuit to recover damages. Call us today for a free evaluation of your potential medical malpractice claims.

Motorcycle Accidents

Motorcycling can be exhilarating, but riders and passengers are at a high risk of being seriously injured in a collision. Despite the public bias against motorcycle riders as being reckless thrill seekers, injured bikers are entitled to just compensation for injuries caused by negligent drivers. Furthermore, although there is a “serious injury” requirement for injuries sustained in a car accident, this requirement does not apply to motorcycle riders in order to recover damages for their injuries. We have extensive experience handling motorcycle accident cases and have recovered millions of dollars for motorcyclists just like you! Call us today to protect your rights.

Pedestrian Accidents

Because the streets of Long Island and New York City are not pedestrian-friendly, accidents are more common than you think. Even though pedestrians must follow traffic laws and exercise reasonable care for their safety, negligent drivers will be held liable for pedestrian accidents and injuries. Pedestrians injured in a car accident must file for New York No-Fault Benefits in order to recover for medical bills and lost wages. We assist in filling out and filing the required No-Fault Benefits application, which must be done within 30 days of the accident. We will then attempt to negotiate a settlement for your damages. If the insurance company fails to put forth a fair offer, we will file a full in-court lawsuit and fight for every dollar you deserve! If you or a loved one has been injured in a pedestrian accident, call us today to protect your rights.

Premises Liability

Our firm regularly handles premises liability claims arising from slip and fall accidents, defective sidewalks or stairways, limited or inefficient lighting, potholes, dog bites, swimming pool accidents, fires, toxic exposure (e.g. mold, fumes), and assaults due to negligent security. Each type of claim has its own facts and circumstances to prove in order to reach a successful outcome. We have been winning Premises Liability cases for the past 25 years and have recovered millions of dollars for our clients just like you!

Product Liability

Manufacturers and distributors have a duty to ensure the products they provide to consumers are safe. If a product is defectively designed or manufactured or has failed to adequately warn of its dangers, the manufacturer and/or distributor can be held strictly liable for injuries resulting from any of these defects. We have handled a substantial number of product liability claims and have recovered substantial settlements for our clients. Call us today to discuss your potential claim.

Slip and Fall Accidents

Property owners throughout Long Island and New York City must maintain their property in a reasonably safe condition and provide visitors with a safe environment. Our firm represents victims of slip, trip, and fall accidents caused by spills, broken steps, raised sidewalks, potholes, poorly lit areas, snow and ice as well as many other hazards. Each slip-and-fall matter has its own specific set of facts which requires an individualized plan for a proper investigation. We often immediately visit the site of the occurrence to obtain photographs and other evidence before it is removed or repaired. If you have been injured in a slip-and-fall accident, call us today to protect your rights.

Truck Accidents

Collisions involving trucks and tractor-trailers can result in catastrophic injuries and fatalities to occupants of smaller vehicles. Our firm works to hold negligent trucking companies and truck drivers accountable for accidents that result in injuries and wrongful death. Most truck vehicles are registered out of state and require immediate investigation to determine the proper parties. If you or a loved one has been injured due to the negligence of a truck or tractor-trailer driver, you need to call us today. We will begin an immediate investigation to protect your rights.

Wrongful Death

If you have lost a loved one due to another party’s negligent, reckless, or malicious conduct, we can help you file a wrongful death lawsuit to obtain just compensation for your losses. New York’s Wrongful Death Statute of Limitations is shorter than its general negligence time limitations so you need to call us today. We will work on your case as you and your family take the time to properly deal with this devastating life event.

Regardless of the incident that caused your injuries, you need the powerful representation The Saul Law Firm provides. We have a well-earned reputation as skilled negotiators and zealous advocates, and we will fight for every dollar you deserve.

How long do I have to file a personal injury claim?

In New York, the time limit or statute of limitations for filing a personal injury claim is three (3) years from the date of the accident or injury. The time limit for a wrongful death action is two (2) years. The time limit for a medical malpractice claim is generally two and a half (2-½) years, however, there are nuances that may change that time frame. The sooner you contact our attorneys, the better your chances of achieving a successful outcome.

How much is my personal injury claim worth?

Although each case varies, the compensation you might receive depends on the nature of the accident, the severity of your injuries, and other factors. With this in mind, you could potentially recover for both economic and non-economic damages:

  • Economic damages account for lost earnings, past and future medical costs, property damages, and related financial losses
  • Noneconomic damages reimburse you for intangible losses, including pain and suffering, physical impairment, disfigurement, amputation, and diminished enjoyment of life.

Punitive damages might also be available if the defendant acted recklessly or illegally, such as by driving under the influence. The purpose of these damages is to punish the defendant’s misconduct and discourage others from participating in similar wrongdoing.
